Terms of Use

These Terms of Use ("Terms") govern your access to and use of mapleleafgarden.com ("Site") and your visit to the physical premises of Maple Leaf Garden ("Park"). The Site and Park are operated by Maple Leaf Garden Inc. ("we", "us", "our"), a company incorporated under the laws of British Columbia, Canada. By using the Site or visiting the Park, you ("you", "User", "Guest") agree to these Terms in full.

1. Definitions

1.1 Service — the Site, the Park, all attractions within the Park, and any digital or in-person services we offer.

1.2 User / Guest — any natural person who uses the Site or enters the Park.

1.3 Content — text, photographs, videos, audio, designs, layouts, and any other material made available on or through the Service.

2. Acceptance of Terms

2.1 By using the Service you confirm that you are at least 13 years of age. Users under 18 must have a parent's or legal guardian's consent. Children under 15 must be accompanied within the Park by a guest aged 18 or older.

2.2 If you do not agree to these Terms, do not use the Service.

3. Description of Service

We provide an information website about a privately operated rainforest park containing a suspension bridge, elevated walkways, cliffside trails, an Indigenous heritage area, and on-site restaurants. Operating hours and seasonal programming are described on our Visit page and may change at our discretion.

4. User Conduct & Prohibited Uses

While using the Site or visiting the Park, you agree not to:

  • climb on or over railings, cables, or barriers anywhere in the Park;
  • operate drones or any other unmanned aerial vehicles within the Park;
  • use selfie sticks, tripods, or extended camera mounts on the Suspension Bridge, Treetops Adventure, or Cliffwalk;
  • bring pets, other than registered service animals, into the Park;
  • scrape, mirror, or use automated means to access the Site;
  • upload malicious code, attempt to bypass security, or interfere with the Site's normal operation;
  • use Park imagery or our trademarks for commercial purposes without a written licence.

5. Intellectual Property

5.1 All Content on the Site is owned by us or our licensors and is protected under Canadian and international copyright law. You may view, print, and share Content for personal, non-commercial use only.

5.2 The names "Maple Leaf Garden", "Treetops Adventure", "Cliffwalk", "Kia'palano" and the Capilano bridge mark are our trademarks. Use without our written consent is prohibited.

5.3 Indigenous artwork displayed at Kia'palano is the cultural and intellectual heritage of the carvers and their nations. It must not be photographed for commercial use without permission.

6. Termination

6.1 We may suspend or revoke your access to the Site or remove you from the Park at any time, with or without notice, for breach of these Terms or for conduct we reasonably consider unsafe, disruptive, or harmful to other guests, staff, or the natural environment.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE PARK INVOLVES PHYSICAL ACTIVITY, ELEVATED WALKWAYS, AND NATURAL TERRAIN; YOU ASSUME ALL RISKS ASSOCIATED WITH ENTRY AND USE OF THE ATTRACTIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAPILANO BRIDGE PARK INC., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY ON WHICH SUCH CLAIM IS BASED. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CA$100).

9. Changes to Terms

We may revise these Terms at any time. Material changes will be reflected in an updated Effective Date and Version. Continued use of the Service after revisions constitutes acceptance.

10. Governing Law & Dispute Resolution

10.1 These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

10.2 Any dispute arising under or in connection with these Terms shall be resolved exclusively in the courts of British Columbia, Canada, and you irrevocably submit to that jurisdiction.

10.3 If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect (severability).
